Sample Letters of Termination
Sexual Harassment



Provided are example letters of termination along with information that is going to be beneficial in reducing your chances of a wrongful termination charge.

Remember how important Good Leadership skills are during the entire process from the investigation to issuing the termination notice.

Here are some assumed facts that we will use for the sample below:


Letters of Termination
Assumptions

1. That you have an employee handbook that covers sexual harassment.

2. That you have a copy of their signature on a document showing that they have read, understand and received a copy of your employee handbook, dated June 1, 2005.

3. That the employee did violate the sexual harassment policy by repeatedly asking an employee out on a date. That the other employee clearly stated they were not interested. That the complainant reported this to you, the supervisor, on May 5, 2008.

4. That the employee in question had attended your annual refresher training on sexual harassment on February 19, 2008.

5. That the employee in question had received a written warning for violating your sexual harassment policy on December 14, 2007, for the same offense; however, a different employee.

6. That you had interviewed the employee in question and they confirmed they had asked the other employee out. Although there was some question as to the number of times and if the other employee had made it clear that they were not interested.

7. You have a statement from the complainant where she states that she was asked out six times by the employee and each time she told him that she was married and was not interested.


Sample Termination Letter


Dear Mr. Peterson:


Your employment with Johnson's Siding is being terminated effective May 7, 2008, for violation of our company's sexual harassment policy.

Specifically, you repeatedly, a total of six times, asked another employee for a date after they had made it clear that they were not interested. You confirmed that you had requested a date with them in your statement to your supervisor.

You were issued a written warning for similar behavior on December 14, 2007. You also received annual training on our sexual harassment policy on February 19, 2008. Finally, you had acknowledged by your signature that you were provided a copy of our company employee policy manual on June 1, 2005, which outlines our company policy on sexual harassment and the possible consequences of violating it.

Based on your state you would place any required information here, such as final pay, vacation time remaining, etc.
