Sample Letters of Termination Sexual Harassment
I have provided some sample letters of termination on my website with some basic information that may be helpful in avoiding a wrongful termination claim. Good Leadership skills must be applied throughout the termination process, including the investigation. Here are some basic assumptions that I am using for the sample termination letter below: Letters of Termination Assumptions
1. That you have an employee handbook that covers sexual harassment. 2. That you have a copy of their signature on a document showing that they have read, understand and received a copy of your employee handbook, dated June 1, 2005. 3. That the employee did violate the sexual harassment policy by repeatedly asking an employee out on a date. That the other employee clearly stated they were not interested. That the complainant reported this to you, the supervisor, on May 5, 2008. 4. That the employee in question had attended your annual refresher training on sexual harassment on February 19, 2008. 5. That the employee in question had received a written warning for violating your sexual harassment policy on December 14, 2007, for the same offense; however, a different employee. 6. That you had interviewed the employee in question and they confirmed they had asked the other employee out. Although there was some question as to the number of times and if the other employee had made it clear that they were not interested. 7. You have a statement from the complainant where she states that she was asked out six times by the employee and each time she told him that she was married and was not interested. Sample Letters of Termination
May 7, 2008 Dear Mr. Employee XYZ, This letter is to inform you that your employment with XYZ Company has been terminated effective May 7, 2008, for violation of our company's sexual harassment policy. Specifically, you repeatedly, a total of six times, asked another employee for a date after they had made it clear that they were not interested. You confirmed that you had requested a date with them in your statement to your supervisor. You received a written warning for similar behavior on December 14, 2007. You also received annual training on our sexual harassment policy on February 19, 2008. Finally, you had signed acknowledging that you had read, understood, and received a copy of the employee handbook on June 1, 2005, which outlines our company policy on sexual harassment and the possible consequences of violating it. Based on your company you would place any information about COBRA here. Based on your state you would place any required information here, such as final pay, vacation time remaining, etc. Mr. Employee XYZ, we do want to wish you success in any future endeavors that you have. Sample Letters of Termination
If the employee has any company property it is important to try and get it at the time of termination. If not, and your state allows for you to hold back pay until you receive it, you may want to do that. Give them a deadline to do so. Also, it is wise to escort them off company property Do this with respect. Remember to include all information in your employee handbook. This goes a long way in helping to eliminate any future questions about your policy, and avoiding possible wrongful termination claims. One of the most important aspects is to be consistent.
